This is an Administrative Compliance Order pursuant to Section 311(c) of the Clean Water Act, 33 U.S.C. Section 1321(c), issued to R.H.S. Lee, Inc. The violation involves a significant threat of an oil discharge to waters of the U.S. The Order directs the Respondent to abate the discharge threat and to submit a workplan for site investigation and remediation to remove oil contamination that presents a substantial threat of discharge to waters of the United States, including the Pacific Ocean adjacent to Pearl City, Hawaii. RHS Lee is a trucking, demolition, masonry and grading company that stores oil in connection with its business. During a recent inspection, EPA�s inspector observed oil and oily water discharges at the Site. The facility had inadequate secondary containment and diversionary structures to prevent releases from the Site. Its facility is located approximately fifty feet uphill from a storm drain that discharges into the ocean. Pursuant to the present order, RHS Lee must submit a work plan for EPA approval. The actions required by the order include implementation of immediate measures to halt the discharge of oil, sampling and post-removal controls.
