This facility failed to apply for permit coverage as required by the new CAFO rule. The new CAFO rule required all facilities defined as CAFO under the old CAFO to apply for permit coverage by April 14, 2003. Also, this facility improperly land applied manure at rates exceeding agronomic rates.
RELIEF: Immediately take all necessary measures to prevent any discharge of pollutants to waters of the U.S., initiate a weekly visual inspection program, submit information concerning discharges of pollutants within the last 5 years, and arrange a Show Cause meeting with EPA.
