On August 9, 2004, a New Jersey Department of Health inspector conducted an inspection at the facility. Respondents violated 40 C.F.R. 61.145(b), a regulation promulgated pursuant to Section 112 of the Act, by failing to submit a 10-day nofication of intent to demolish a facility.
