On July 6, 2015, the United States District Court for the Eastern District of Pennsylvania Issued an Order Granting the United States and Defendants? Joint Motion to Modify the Consent Decree entered by the Court on July 12, 2005. The Consent Decree embodies a settlement of the United States' claims under Sections 106 and 107(a) of the Comprehensive Environmental Response, Compensation, and Liability Act, 42 U.S.C ?? 9606 and 9607(a), against Defendants Sequa Corporation and John H. Thompson, in connection with the Dublin TCE Superfund Site, located in Borough of Dublin, Bucks County, Pennsylvania. The Consent Decree also provides that if certain milestones are met, the United States may endeavor to provide, at its discretion and not subject to dispute resolution, funding to the Defendants from EPA to implement the Contingent Remedial Action selected in the Record of Decision. Pursuant to the Order, the United States? potential obligation to provide funding for the Contingent Remedy, subject to availability, was extended from ten (10) years from the date of entry of the Consent Decree or July 12, 2015 to thirteen (13) years or July 12, 2018.
