## Summary

The Consent Agreement and Final Order filed in this matter simultaneously commences and resolves sixteen (16) claims alleging violations of Section 16(a) of the Toxic Substances Control Act (ï¿½ï¿½ï¿½TSCAï¿½ï¿½ï¿½), 15 U.S.C. ï¿½ï¿½ 2615(a) as a result of  violations of the Residential Lead-Based Paint Hazard Reduction Act of 1992, 42 U.S.C. ï¿½ï¿½ï¿½ï¿½ 4851 et seq. (ï¿½ï¿½ï¿½Title Xï¿½ï¿½ï¿½) and the underlying federal lead disclosure regulations at 40 C.F.R. Part 745, Subpart F (ï¿½ï¿½ï¿½Disclosure Ruleï¿½ï¿½ï¿½).  As a general matter, the violations described in Consent Agreement arise from Target Investments Property Managementï¿½ï¿½ï¿½s (Targetï¿½ï¿½ï¿½s) failure to ensure that the following statements were provided to the respective lessees, either as an attachment to, or within, the seven leases at issue: 1) a ï¿½ï¿½ï¿½Lead Warning Statementï¿½ï¿½ï¿½ containing the language set forth in, and required by, 40 C.F.R. ï¿½ï¿½ 745.113(b)(1); 2) a statement by the lessor disclosing the presence of known lead-based paint and/or lead-based paint hazards in the target housing being leased or indicating no knowledge of the presence of lead-based paint and/or lead-based paint hazards, as required by  40 C.F.R. ï¿½ï¿½ 745.113(b)(2); and/or 3) a statement that the agent has informed the lessor of the [lessorï¿½ï¿½ï¿½s] obligations under 42 U.S.C.  4852d and the agent is aware of his/her duty to ensure compliance with the requirements of 40 C.F.R.
