On May 12, 2010, the Regional Administrator signed a Consent Decree settling EPA = s claims for penalties and injunctive relief arising from a judicial Default Judgement and Order issued to Tanana Oil Corporation, Tri-Angle Holding Corporation, and Edgemere/Tri-Angle Holding Corporation ( A Original Defendants @ ) for violations of Subtitle I of RCRA, 42 U.S.C. ' ' 6991-6991m, and the State of Maryland = s authorized underground storage tank ( A UST @ ) program. The settlement between Dale Miller and Sue Miller ( A Added Defendants @ ), as individuals and as representatives of the Original Defendants, resolves EPA = s claims against the Defendants and is based in part on an A Ability to Pay Analysis @ conducted by Region III in conjunction with the Department of Justice ( A DOJ @ ) during the negotiations. The violations concern the Defendants = facility known as Tanana Oil Station No. 409 ( A the Facility @ ) which is located at 7526 North Point Road in Edgemere Maryland. The Consent Decree requires the Millers to pay a civil penalty within 30 days of entry, and an additional civil penalty on the two-year anniversary of entry. The Consent Decree also orders the Millers to clean up the site where the Facility is located. The State and EPA estimate that the clean-up will take two years.
