## Summary

On December 22, 2005, Region 5 filed a Consent Agreement and Final Order (CAFO) resolving an administrative penalty and compliance action against Doboy, Inc. (Doboy), located at 869 South Knowles Avenue, New Richmond, Wisconsin. The CAFO resolves the company's alleged violation regarding failure to comply with certain regulations found at Wisconsin Administrative Code (WAC) NR 610.05 [40 CFR 262.11]. Specifically, Doboy did not fully comply with the requirements to determine if generated waste paint filters, which were a solid waste, were hazardous or non-hazardous waste. The CAFO requires Doboy to pay a civil penalty of $52,246.

From around October 2000 to June 2004, the Respondent had not determined if its approximately 48 generated waste paint filters, that exceeded the regulatory limit for barium, were hazardous or non-hazardous waste. The Respondent had changed their ingredients and color of their paint primer which should have led to a re-characterization of the spent paint filters. The filters that were spent containing the previous paint primers before October of 2000 were tested as non-hazardous for barium.
