Respondent is an operator at the Pik Quik Store located at 3811 E. Lohman, Las Cruces, NM, a commercial construction project. Respondent was inspected on November 3, 2004, and found to be in violations of the NPDES storm water construction general permitting program by failing to 1) have an NPDES permit from June 1, 2004, to date of inspection, and 2) failing to have prepared a Storm Water Pollution Prevention Plan. Respondent was issued an Administrative Order on May 18, 2005, at which time an Expedited Settlement Offer was extended. The Offer was accepted and Cambro Construction certified they were in compliance with the requirements of the permit, and the Compliance Agreement and Final Order was signed and routed for final EPA signatures and Public Notice.
