Violations of record keeping and leak repair requirements of Section 608 of the Clean Air Act Stratospheric Ozone Protection and its implementing regulations (40 C.F.R. Part 82 Part); Injunctive relief to retire or retrofit appliances and monetary penalties, Supplemental Environmental Projects will be sought. Region 5 is the lead EPA Region in this nation-wide matter.
The judicial complaint filed alleged that Bristol Myers-Squibb violated CAA Section 608 and repair, record keeping and reporting requirements of 40 CFR Part 82, Subpart F (Recycling and Emission Reduction) pursuant to Subchapter VI of the CAA. The CD requires BMS to pay a civil penalty, perform SEPs replacing two refrigeration units using ozone depleting substances with units using non ozone depleting substances, and retire or retrofit 15 commercial or industrial process refrigeration units located in Region 2.
