U.S. EPA, IDEM, and HDEM entered into a Consent Decree agreeing not to sue Jupiter Aluminum under Section 113 of the Clean Air Act (ÂCAAÂ), 42 U.S.C. § 7613, for violating Section 112 of the CAA, 42 U.S.C. § 7612, and the applicable requirements of the National Emission Standards for Hazardous Air Pollutants (ÂNESHAPÂ) for Secondary Aluminum Processing, codified at 40 C.F.R. Part 63, Subpart RRR (Subpart RRR) prior to the date of lodging of the Consent Decree in consideration of Jupiter paying a penalty in the amount of $2,000,000.00 and coming into compliance with Subpart RRR.
