Summary

On May 7, 2010, a Consent Decree was entered in the US District Court for the Western District of Washington in the case of US v. Saint Gobain Containers, Inc. (SGCI). The Consent Decree resolves violations of the CAA?s new source review provisions at fifteen SGCI facilities in nine EPA regions, including the Port Allegany, PA facility in Region III (Region X was the lead region for the case). The Consent Decree provides for federal civil penalties that are apportionable to the Port Allegany facility. It is expected that, as a result of the injunctive measures at the Port Allegany facility, there will be reductions in emissions of Nitrogen Oxides, sulfur dioxide, and particulate matter. Region 10 is the lead region.
