## Summary

Respondents operated a hazardous waste management facility and stored, treated and/or disposed of hazardous waste without having obtained a permit or qualifying for interim status, and did so for an extended period of time. Respondents treated or disposed of in an unauthorized manner of an approximate amount between 50,000 and 60,000 pounds of hazardous waste.

In addition, Respondents:
Released mercury vapor to the atmosphere through the disposal of spent fluorescent light bulbs as trash in the regular garbage;
Storaged perc solvent in drums and tanks, adjacent to channels and floor drains leading to a sump and public sewer, risking release in the event of a spill or leak (especially when refilling the dry cleaning machines); and
Storaged hazardous waste perc in open drums and open containers.  Such storage increases the release of perc into the air, the risk of spills and the health risk to employees and others in the vicinity of the facility who may be exposed to perc, a volatile organic compound.  Since some of these were adjacent to channels and floor drains leading to a sump and public sewer, the risk of a release into the environment in the event of a spill or leak is heightened.  

This Case Action seeks to bring a halt to the aforementioned activities.
