Respondent is a corporation in the state of Texas and operates a construction project and as such, is a Permitee subject to the regulations of the Clean Water Act and the National Pollutant Discharge Elimination System(NPDES) Storm Water Regulations. The Permitee owned or operated the El Dorado Estates, Phase I West project located in Little Elm, Texas 75068. The Respondent discharged pollutants in and with its storm water to the receiving waters of Cottonwood Branch, which are waters of the United States. The Respondent was in violation of the CWA and is being issued an Administrative Order for Complicance.
