Michigan Sugar Company (MSC) is the defendant in this matter. In August 2004, US EPA issued Section 114 Information Requests to MSC requiring tests for Carbon Monoxide (C0) and volatile organic compound emissions (VOC) to be conducted on pulp dryer #3 at the Bay City facility and on pulp dryer #3 at the Sebewaing fcility. The results of the emission tests were received by U.S. EPA in January 2005 and showed CO and VOC emissions to be significantly higher than MSC had been reporting and above the Prevention of Significant deterioration (PSD) significance levels for CO and VOC at the Sevewaing facility and for CO at the Bay City facility.
