Summary

Based upon information gathered by EPA during the April 27, 2005 CEI, PRASA�s bypass notifications sent to EPA on June 6 and July 20,2005, and the DMRs from July 2004 through June 2005, EPA finds that PRASA is not in compliance with its NPDES permit. EPA found that PRASA violated the permit by its failure to: (1) provide adequate operation and maintenance; (2) avoid by-passing of its treatment facilities; (3) take affirmative actions to terminate the violations of the permit; and (4) timely bring the facility into compliance with the Act. Immediately upon receipt of this ORDER, PRASA shall maximize the Operation and Maintenance at the facility in order to achieve and maintain compliance with the facility�s final effluent limitations set out in the permit. Within 30 calendar days of receipt of the Order, PRASA shall submit a compliance plan to EPA that outlines a schedule, for the completion of all the permanent repairs needed to correct the deficiencies found at the Guayama RWWTP during the April 27, 2005 CEI. The schedule shall not contain dates beyond 150 calendar days of receipt of the Order. All the treatment modules, pumps, controllers, mechanical and electrical equipment, including, but not limited to, switches, float controllers, alternate power generators, lighting and safety equipment should be in full operational condition. Within 60 calendar days of receipt of the Order, PRASA shall develop a Preventive Maintenance Plan (�PMP�) for the facility that will
