At the time of the violation, facility was owned by El Paso Corp. through it subsidiary El Paso Merchant Energy. El Paso Merchant Energy failed to manifest PCB waste submitted for off-site disposal, a violation of 40 CFR Part 761.207(a). The proposed penalty was $6,400.00. EPA settled this case for $4,800.00
