This is a Civil Judicial Referral pursuant to CERCLA in which EPA requests that the Department of Justice bring an action against the Pitts Grandchildrens' Trust and the Adeline R. Bennett MD Living Trust, potentially responsible parties at the Waste Disposal, Inc. Site. The Complaint will seek injunctive relief for performance of a portion of the remedial action and cost recovery for all unreimbursed past costs, with interest. EPA and the PRPs have negotiated the terms of a consent decree and referred this consent decree to the Department of Justice. The consent decree requires the implementation of institutional controls and requires the settling defendants to sell their site properties and pay EPA up to $4,728,000.
