## Summary

On December 30, 2005, a Complaint and Notice of Opportunity for Hearing( Complaint ) was filed by Region III pursuant to Section 16(a) of TSCA, 15 U.S.C. sub section 2615(a), against Beam Team, Inc., T/A Century 21 Dale Realty Property Management Co., and Dale and wade Elfner d.b.a Century 21 Dale Realty Co.  The Complaint alleges 141 violations of the Residential Lead-Based Paidnt Hazard Reduction Act of 1992.  This case involves the Respondents' failure to include as an attachment or within each lease agreement:  the Lead Warning Statement; a statement disclosing the presence of know lead-based paint and/or lead-based paint hazards; or a statement that the agent had informed the Lessor or the Lessor's obligations and that the agent is aware of his duty to ensure compliance.  This cas is significant because the Lessees for five of the leases at issue in this Complaint had children under the age of six when they entered into the lease.  Children under age six are especially vulnerable to the dangerous effects of lead poisoning, since lead poisoning can impair the neurological development that occurs at this age. The Agency is not proposing a specific penalty at this time, but pruposes the assesment of a civil penalty of up to the statutory maximum of $11,000 against Respondents for each violation
