This violation arises from an unpermitted discharge of anhydrous ammonia from the Fred Meyer Distriction Center on Nov. 22, 2002. Fred Meyer was not authorized to discharge pollutants under CWA-402. The ammonia was discharged through a storm drain into Carli Creek, a tributary to the Clackamas River. Due to the discharge, everything in a one-half mile of Carli Creek was killed. EPA Region 10 believes that due to the egregiousness of this violation, the maximum penalty of $32,500 should be sought.
