Summary

On September 17th, 2002, the United States entered a civil settlement under Sections 104(e) and 107 of CERCLA, with Defendants Economic Industrial Properties, Thomas R. Allen, Jr., Morton J. Greene, Carol M. Allen and Anne S. Greene. This settlement (Docket C.A. No. 96-579) resolves the prior Complaint filed in this matter pursuant to Sections 104 and 107 of CERCLA, wherein the U.S. sought penalties for failure to respond timely and fully to EPA's information requests, and reimbursement of response costs incurred and to be incurred for response actions taken at or in connection with the release or threatened release of hazardous substances at the Bollinger Steel Superfund Site in Ambridge, Beaver County, PA ( The Site ). Under the terms of the Settlement, Defendants have agreed to pay the United States $250,000, and to sell the Site property in accordance with the terms of the Consent Decree. To date, Defendants are in compliance with the terms of the Decree.
