Summary

An Administrative Consent Order (ACO) is being issued to Blommer Chocolate (Blommer) to resolve alleged Illinois State Implementation Plan (SIP) opacity violations that were identified in a Notice of Violation issued to Blommer on October 25, 2005. U.S. EPA alleged that Blommer was in violation of the 30 percent opacity standard, found in Title 35 of the Illinois Administrative Code �� 212.123, at its grinder stack. A U.S. EPA certified inspector conducted Method 9 visible emission readings at the Blommer facility on September 1, 2005 and September 2, 2005. Emissions exceeding the SIP limit of 30 percent opacity were observed at the facility on both days. To resolve the alleged violations, Blommer will install and operate five filter boxes to be used as pollution control devices for the grinders at the facility. Blommer will perform two (2) Method 9 visible emission readings at their grinder stack according to the schedule set forth in the ACO. If the filter boxes fail to achieve compliance with visible emission opacity levels, Blommer will modify the filter boxes or take other appropriate measures that will allow the facility to comply. An additional Method 9 reading will be performed in the case of such an occurrence.
