BASF Canada Inc. through their import broker, submitted a Notice of Arrival (NOA) declaring that on 6/8/05 they planned to import 9,000 Kg (10,900 Kg totes) of Mycostat P from Germany. Information submitted with the HNOA revealed that the product label contained a Canadian EPA establishment number yet had been imported from Germany. The EPA requested tht the Oregon Department of Agriculture (ODA) conducted an import inspection of the shipment to determine what establishment number appeared on the label. On 6/14/05, ODA examined the shipment and found that the products were actually labeled with Canadian labels and did not bear the EPA accepted label for Mycostat P. On 6/16/05, EPA issued a SSURO to gain control over the violative product which outlined criteria tht the import must meet in order to further sell and distribute the product. This penalty action is in follow up to EPA's Stop Order Sale.
