The Respondents in this civil administrative ase - Sunset Vista Apartments, LLC., Stanley Xu, et al, - are alleged to have violated section 409 of TSCA, 15 USA 2689, by failing to comply with the regulatory requirements of 40 CFR Part 745 Subpart F to provide lessees, including lessees with young children, with the EPA-approved lead hazard information pamphlet, with a Lead Warning Statement, with statements disclosing the presence of known lead-based paints/paint hazards i target housig or of a lack of knowledge of such paint/paint reports/records exist, with statements certifying receipt of such information, or with certifications as to the accuracy of such information provided. The alleged violations amount to sixty (60) counts of separate violations of the Disclosure Rule.
