Respondent disclosed, in a 114 letter response, that they had failed to submit asbestos notifications for demolition projects conducted in 2005, as required by 40 C.F.R. ý 61.145(b). Respondents response to the 114 letter resulted in a total of 28 counts of failure to notify. All demolition projects listed in the 114 response concerned buildings that allegedly did not contain asbestos at the time of the demolition activity.
