The United States Environmental Protection Agency (EPA) has reached a settlement with Silgan Containers that will resolve alleged Clean Air Act (CAA) violations of the Prevention of Significant Deterioration/New Source Review (PSD/NSR) programs at 18 Silgan can manufacturing facilities across the United States.
In October 1999, Silgan commenced a national air audit ( NAA ) of the company's compliance with the CAA under an audit agreement with EPA and conducted a review of each facility (originally, a total of 28) on a Region-by-Region basis. Silgan disclosed noncompliance with PSD/NSR and other CAA requirements and voluntarily corrected noncompliance. Silgan disclosed the potential violations to Regions 2, 4, 5, 7, 9, and 10.
The settlement agreement requires payment of a $365,000 civil penalty. Complying actions undertaken as a result of the audit agreement and settlement cost over $10 million and will result in reduction and/or elimination of over 636 tons per year of volatile organic compounds.
