## Summary

RINECO CHEMICAL CO, BENTON, AR : On August 16, 2010, the Court signed the 
Consent Decree reflecting its approval of the proposed Consent Decree.  The Consent Decree was entered unopposed and constitute a final judgment of the RCRA noncompliance issues at the Rineco Chemical Co. facility in Benton, Arkansas (Rineco).  The noncompliance issues were:  (1) operating thermal treatment and storage units without a permit, (2) failure to notify of waste activity, (3) failure to provide financial assurance, and (4) failure to comply air emission requirements.  Rineco will pay a civil penalty of $1.35 million.  The result of this action has eliminated 4.2 million pounds of hazardous waste emissions into the environment.  In addition, Rineco will invest $1.5 million in physical and non-physical remedies to obtain compliance.

Modification to CD:  There was an extension for one year on their permit.
