Respondent's tank battery was a point source discharge of a pollutant , more specifically oil field brine, to a tributary of Pond Creek which is waters of the U.S. This discharge resulted in a violation to the Clean Water Act and the National Pollutant Discharge Elimination System program. Order is requiring the Respondent to immediately cease all dicharges from the tank battery and remove the brine from the tributary.
