FINDINGS:
THE DMRs SUBMITTED TO TDEC BY LEXINGTON INDICATE THAT LEXINGTON HAS DISCHARGED POLLUTANTS IN VIOLATION OF EFFLUENT LIMITATIONS ESTABLISHED IN ITS PERMIT.  THE SPECIFIC VIOLATIONS ARE AS FOLLOWS:

A. DISSOLVED OXYGEN DURING THE QUARTERS ENDING SEPT 2007 AND MARCH 2008.

B. AMMONIA DURING THE QUARTER ENDING JUNE 2006.

C.  E. COLI DURING THE QUARTERS ENDING DEC 2006 AND DEC 2008.

D. TOTAL RESIDUAL CHLORINE DURING THE QUARTERS ENDING DEC 2005, DEC 2006, DEC 2007, MARCH 2008, JUNE 2008, AND DEC 2008.

LEXINGTON HAS VIOLATED SEC 301(a) OF THE CWA, AND THE PERMIT, ISSUED PURSUANT TO SECTION 402 OF THE ACT, IN THAT LEXINGTON FAILED TO COMPLY WITH THE DISSOLVED OXYGEN, AMMONIA, E.COLI, AND TOTAL RESIDUAL CHLORINE LIMITS AND REQUIREMENTS OF THE PERMIT AS SET FORTH HEREIN.

ORDER:

LEXINGTON SHALL:

A. COMPLETE MODIFICATIONS TO AERATION BASINS TO INCREASE AIR SUPPLY AND OXYGEN TRANSFER AND TO ALLOW FOR ON-LINE MONITORING OF DISSOLVED OXYGEN.

B. COMPLETE MODIFICATIONS TO AERATION BASIN BLOWERS TO ALLOW FOR AUTOMATIC RESTART OF THE EQUIPMENT AFTER A POWER FAILURE.

C. COMPLETE THE INSTALLATION OF AN AUTOMATIC CHEMICAL FEED CONTROL SYSTEM FOR CHLORINATION/DECHLORINATION AND NITRIFICATION/DENITRIFICATION.

D. COMPLETE THE INSTALLATION OF TELEMETRY AND ALARM EQUIPMENT FOR LOW DISSOLVED OXYGEN AND CHLORINE RESIDUAL.

E. BY AUG 1, 2009, SUBMIT PLANS AND SPECIFICATIONS TO THE STATE OF TENNESSEE FOR REVIEW.
