Summary

EPA conducted a Compliance Evaluation Inspection (CEI) at the Raritan Town Square, LLC site (“site”) located at 150 Route 31 in Raritan New Jersey on July 23, 2009. The site is a sixty (60) acre commercial development containing a future Walmart and other commercial establishments. The facility obtained coverage under the New Jersey Department of Environmental Protection’s (NJDEPs) Construction Activity Stormwater General Permit (Construction General Permit, CGP or Permit) on September 19, 2005. Stormwater discharges from the site flow through the on site storm sewer system into stormwater retention ponds which discharge to a tributary to the South Branch Raritan River. During the inspection, EPA found the following deficiencies as required by the CGP, failed to develop and implement the Waste Control Component of the Storm water Pollution Prevention Plan (SPPP), waste material disposed in two uncovered dumpsters, waste material disposed in an unprotected waste pile, annual reports and weekly inspection records were not available/did not exist, stormwater BMPs were not consistently maintained at the site. Within 30 calendar days of receipt of this Order, Raritan Town Square, shall develop a thorough and current SPPP for the entire site including an erosion and sediment control plan and the construction site waste control component.
