The primary violations involved storage, transportation, and disposal of a RCRA hazardous waste, anhydrous magnesium chloride waste (D003 characteristic for reactivity) without a permit or interim status. The referral was the result of an investigation conducted jointly by EPA Region 10, the National Enforcement Investigations Center (NEIC), and the State of Oregon Department of Environmental Quality (ODEQ). The company agreed to pay a penalty of $825,000, and committed to specific record-keeping requirements related to waste determinations performed on all wastes that are potentially reactive or ignitable.
