## Summary

On March 16, 2011, the Region filed a Consent Agreement and Final Order (CAFO) settling an administrative penalty action against 122 Chestnut, L.L.C. (Respondent) regarding alleged violations of the Lead-Based Paint Disclosure Rule under Section 1018 of the Residential Lead-Based Paint Hazard Reduction Act of 1992.  The violations included a failure to provide records or reports regarding lead hazards, ensure that the contract to lease included a Lead Warning Statement and a statement by the lessor disclosing the presence of known lead-based paint or lead-based paint hazards or indicating no knowledge thereof, and failure to provide a copy of EPA’s lead hazard information pamphlet to ten lessees.  Pursuant to the CAFO, the Respondent will pay a $6,000 cash penalty, based on EPA’s determination of Respondent’s ability to pay.
