On December 7, 2010, Region I filed an administrative consent agreement and final order (CAFO) to resolve a civil penalty case against Promet Marine Services Corporation, a Providence, Rhode Island shipyard. The CAFO requires payment of a $290,000 penalty to resolve numerous violations of the Clean Air Act and Clean Water Act. Clean Air Act violations included failure to obtain and operate in compliance with permits issued under the Rhode Island State Implementation Plan and Title V and failure to comply with various reporting, recordkeeping and emissions requirements specified in the MACT (maximum achievable control technology) regulations applicable to shipbuilding and ship repair facilities. Clean Water Act violations included the unauthorized discharge of pollutants in pressure wash water into the Providence River.
