On May 29, 2013, the Department of Justice entered a consent decree (CD) in the federal district court of New Hampshire resolving CWA violations against Torromeo Industries, Inc. stemming from unpermitted process water and stormwater discharges from its concrete manufacturing and sand, gravel, and stone mining operations in Kingston, New Hampshire. The CD requires the company to pay a civil penalty of $135,000 and perform a Supplemental Environmental Project worth $529,310 in which it will remove an impervious parking lot adjacent to CobbettÂs Pond, in Windham, N.H., and replace it with a 35,000 sq. foot pervious concrete parking lot.
The Region has coordinated with the NH Department of Environmental Services and the NH Attorney GeneralÂs Office which concurrently resolved additional violations with the company involving approximately 12.5 acres of filled wetlands and streams around the Kingston, NH site.
