ON THAT DATE, ABITIBIBOWATER FILED A VOLUNTARY PETITION FOR RELIEF UNDER CHAPTER 11 OF TITLE 11 OF THE U.S. CODE IN AN ACTION TITLED IN RE BOWATER INC. NO. 09-11311(KJC).

On August 9, 2009, the US was given an allowed general unsecured claim for the penalty of $30,000. Under the debtor's confirmed bankruptcy plan, general unsecured claimants received a pro rata share of stock in the re-organized debtor (we received 448 shares in December of 2010. There should be no further bankruptcy court activity in this matter on our claim.
