On September 16, 2011, EPA filed a Consent Agreement and Final Order against David D�Amato that resolves a filed case concerning wetlands violation in Anchorage, AK. The violations include unpermitted ditch maintenance activities and placement of sidecast materials in wetlands on a 29-acre parcel. The wetland area affected by these activities is approximately 0.7 acres. EPA�s case was filed in July 2010 and the case was set for hearing in September 2011. The penalty to be paid by Mr. D�Amato is $2500 and is based on Region 10�s analysis of the Respondent�s ability to pay. An outstanding compliance order remains in place pending resolution of onsite issues with a lender who is foreclosing on the property.
