On August 18, 2008, U.S. EPA conducted an inspection at the Claypool facility. EPA discovered the violations through this inspection and a review of information submitted by Louis Dreyfus in response to an information request. Specifically, Louis Dreyfus was found to be subject to and in violation of 40 C.F.R. Part 60, Subpart VV. Louis Dreyfus completed the appropriate procedures to come into compliance on October 10, 2008. Under the terms of the settlement, Louis Dreyfus will pay a $77,628 civil penalty.
