On March 9, 2011, the United States District Court for the District of Connecticut entered a Consent Decree in connection with the East Main Street Disposal Area Site (Site) resolving certain past costs claims of the United States against The United Illuminating Company (UI) and The Fitchburg Gas and Electric Light Company (FG&E), under Section 107(a) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), 42 U.S.C. § 9607(a). These entities arranged for disposal of a hazardous substance at the Site. This case was referred to the Department of Justice on April 20, 2010, and has been settled without litigation. In the CD, Settling Defendants agree to make a payment of $464,000 to reimburse EPA for its past response costs. The East Main Street Disposal Area Site is located in Branford, Connecticut. Region I performed a time-critical removal action at the Site in 2006 which included excavation of soils contaminated with polycyclic aromatic hydrocarbons and lead.
