Summary

A settlement agreement was reached in October of 2010 in the Old Carco LLC (f/k/a Chrysler LLC) national bankruptcy case. The settlement agreement involves the Behr Dayton Superfund site in Dayton Ohio, in which EPA obtains: Allowed General Unsecured Claims for response work; Allowed General Unsecured Claims for penalties; and Cost Recovery. An additional settlement agreement was reached in October of 2011 at the Kenosha Engine Plant Brownfields Property. The Liquidation Trust shall pay the total amount of the $10 Million Environmental Reserve Cash to an escrow account (site specific account). Funds from the escrow account shall be used for Environmental Response Actions at the Property.
