DalMex, Ltd is in violation of FIFRA because it is unlawful for any person in any State to distribute or sell to any person any pesticide which is adulterated or misbranded. The Respondent's sale and distribuation of the misbranded pesticide products, identified in paragraphs 20-30, constituted an unlawful act in violation of Section 12(a)(l)(E) of FIFRA. Penalty was issued and paid in full 02/09/2012. Case closed.
