Respondent owned or operated a coal mining facility located in Mckinley County, New Mexico. Respondent violated the Clean Water Act by failing to develop and install adequate structual or non-structual erosion and sediment controls at the low water crossings on the Mulatto Canyou Division in accordance with SWPPP required by coverage under the NPDES permit. Adminstrative Penalty Order is issued for the violations.
