ON JULY 11-18, 2001, REPRESENTATIVES FROM THE ENVIRONMENTAL PROTECTION AGENCY (EPA) INSPECTED THE SITE. THAT INSPECTION REVEALED THAT RESPONDENT WAS NOT PROPERLY PERFORMING MONITORING AS REQUIRED UNDER ITS NATIONAL POLLUTANT DISCHARG DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT, AND HAD NOT FULLY IMPLEMENTED A PREPARDEDNESS, PREVENTION, AND CONTINGENCY PLAN (ALSO KNOWN AS A STORM WATER POLLUTION PREVENTION PLAN). THE ORDER REQUIRED RESPONDENT TO COMPLY WITH ITS NPDES PERMIT. EPA HAS FILED THIS ORDER UNDER THE AUTHORITY OF SECTION 309(A) OF THE CLEAN WATER ACT, 33 U.S.C. SECTION 1319(A).
