On December 20, 2016, EPA assessed Stipulated Penalties in the amount of $25,000 to Weston Solutions, Inc. for failure to comply with the requirements of the Final Remedy Decision for its Chem-Wood Facility, located in Kapolei, Hawaii, in violation of the December 2009 Administrative Order on Consent (AOC) [RCRA 7003-09-2010-01].
The 2009 AOC RCRA Corrective Action included the requirements for:
* Construction and long-term maintenance of an asphalt concrete cap across the site,
* Limited excavation of soil from two adjacent properties and placement under the new cap,
* Monitoring and treatment of any contaminated groundwater,
* Fencing and signs to restrict site access, and
* Deed restrictions on the use of the property and prohibiting residential reuse.
