On August 16, 2010, the Region 5 Water Division issued a wetlands restoration order under Section 309(a) of the Clean Water Act (CWA), 33 U.S.C. § 1319(a) to Jerrel Dungy and Long Prairie Farm LLC of Benton, Illinois. The order applies to four separate farm parcels in central Illinois at which EPA has found that unpermitted filling of jurisdictional wetlands occurred, and orders the submission of a mitigation and wetland restoration plan and schedule for approval by the Water Division.
