Respondent operated a dairy facility which is considered a Concentrated Animal Feeding Operation. The violations were identified during an August 3, 2010 inspection conducted by EPA. Respondent had an unauthorized discharge of pollutant from the retention control structure from multiple locations along the western bern and flowing to an unnamed tributary then to Big Sandy Creek. EPA issued AO for Respondent to immediately cease and desist discharging pollutant to waters of the United States of America and to certify within thirty days that the discharge has been stopped.
