Summary

Aleris International Inc. (Aleris) acquired Wabash Alloys LLC (Wabash) on September 11, 2007. On November 21, 2007, Aleris requested that the Agency enter into an Audit Agreement to evaluate Clean Air Act (CAA), Emergency Planning and Community Right-to-Know Act (EPCRA), and Toxic Substances Control Act (TSCA) compliance at three newly acquired Wabash facilities located in Tipton and Wabash, Indiana, and Steel, Alabama. EPA subsequently entered into an Audit Agreement with Aleris. On April 30, 2008, Aleris submitted information concerning potential violations of the CAA regulations at 40 CFR Part 63, Subpart RRR, and TSCA regulations at 40 CFR 710, under EPA�s April 11, 2000 policy on �Incentives for Self-Policing: Discovery, Disclosure, Correction and Prevention of Violations,� 65 Fed. Reg. 19618 (Audit Policy). In an August 17, 2009 letter, EPA offered, and Aleris accepted, the opportunity to have its disclosure considered under the �Interim Approach to Applying the Audit Policy to New Owners,� 73 Fed. Reg. 44991 (Aug. 1, 2008) (Interim Approach). This Notice of Determination resolves the violations disclosed by Aleris.
