Violations of EPCRA and CERCLA: UniSea failed to report these discharges in a timely manner as required by Section 304 of the Emergency Planning and Community Right-to-Know Act (EPCRA) and Section 103 of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). The penalty for the EPCRA violations is: $975,000.00, and for the CERCLA violations is: $133,250.00. UniSea will also pay the state of Alaska a penalty of $504,125.00 for violations of state regulations. The penalty assessed for the CWA violations is $297,000.
