On September 17, 2010, EPA issued a Notice of Determination (ÂNODÂ) pursuant to the Final Policy Statement on Incentives for Self-Policing Discovery, Disclosure, Correction, and Prevention of Violation, 65 FR 19618 (April 11, 2000). The NOD is based on a self-disclosure provided by Pratt and Whitney Engine Service, Inc. ( Pratt & Whitney ) for violations of Section 313 of the Emergency Planning and Community Right-to-Know Act (ÂEPCRAÂ), 42 U.S.C.
§ 11023, and its implementing regulations at 40 C.F.R. Part 372. The Pratt & Whitney Facility is located at 1525 Midway Park Road, Bridgeport, West Virginia 26330 (ÂFacilityÂ). In an Electronic Disclosure, dated August 3, 2009, and in its October 29, 2009 correspondence, Pratt
& Whitney disclosed that the Facility had failed to submit Toxic Chemical Release Inventory Forms (Forms A and/or Forms R) for chromium and lead reporting years 2005, 2006, and 2007, as required by Section 313 of EPCRA.
