This case addresses violations of the Safe Drinking Water Act's Underground Injection Control regulations by the Jazmin Family Trust in Hawaii. EPA's regulations banned the use of large capacity cesspools after April, 2005. A large-capacity cesspool is one that discharges untreated sewage from multiple dwellings, or from a non-residential location that serves 20 or more people per day. In September, 2010, EPA issued an administrative complaint and proposed order to the Jazmin Family Trust for ongoing cesspool violations at their 15-unit apartment complex in Kona, Hawaii. The final order requires the Jazmin Family Trust to comply by January 31, 2014 and pay a penalty up to $60,000 for failing to close the cesspools by EPA's April, 2005 deadline.
