In 2009, an Administrative Compliance Order was issued to the Respondents for failure to submit a NPDES permit application to discharge storm water associated with construction activities. On September 28, 2010, EPA issued complaint with penalty Docket Number CWA-02-2010-3465. Respondents failed to respond to the Complaint. In 2011, EPA filed a Default Motion, that was granted on January 13, 2022.
