EPA responded to several pesticide incidents at the St. Thomas and St. Croix facilities, including several spills in which it was discovered that pesticides and other solvents had spilled throughout the facility. The facility failed to characterize, properly manage and dispose of hazardous waste and to minimize the possibility of a fire, explosion or releases of hazardous wastes. A Consent Agreement/Final Order was signed between the parties under which the Respondent agreed to pay a final penalty.
Separate cost recovery enforcement under CERCLA. EPA conducted a removal action at the site and incurred monies to remove, clean-up and dispose of the pesticide releases.
